Nope. Both will distract a driver.

What about children in cars? Is that different?
Let me capture the logic, because someone was talking on a cell phone it short circuited her brain and she hit the gas instead of the brake..... RIIIIIIIIGHT! Let's all believe everything that people have an axe to grind writes down, like "The earth is flat".

Everything in the car is considered a distraction. Last year we actually had a project to quantify distractions in the car here at Liberty Mutual (Research Center). The project is finished, that I know, but I don't know what the outcome was, or if it has even been published.
Also, there is a project MIT started a few years ago where you get a device implanted in your tooth. What happens is when you want to listen to something, it vibrates on a molecular level. The vibrations in the jaw make you think you're listening to something through your ears. The idea was to use it as a way to replace headphones for mp3 players. Not sure what happened to the project. Might have been spurned due to the fear of induced schizophrenia.
slapping the kids if definitely a distraction
this one is better

I'll do you one better.
My company had some Americans over from corporate HQ to visit.
So I am in the bathroom, using a urinal, minding my own business, and one of the Americans comes to stand next to me and starts to have a whole conversation using the hands-free earpiece...
