Is it possible that the Federal government agreed to settle because they realize that their appointed thugs, the EPA, had acted in violation of the 5th Amendment, and imposed penalties on this man without "due process"? Could be. Maybe this wasn't so much a case of common sense, maybe more CYA.
This reminds me of something. How much did the EPA fine itself when it spilled mine waste water in the Animas river of Colorado last year?
Unfortunately, the appointed bureaucrats of the EPA are not only immune from public opinion since they are not elected officials and can't be driven from office by legal means required by the US Constitution, they also enjoy sovereign immunity which means they do not have to fine themselves.Quote:

Just 2 miles down the road we had a similar case in fact even worse...
We have a ton of "Drainage Channels" that feed the lake just north of me, and keep the area here dry, they were cut back in the 40's by the ACoE
Well this guy decides he is tired of the messy muddy banks and erosion so he digs the channel through his property slightly wider and deeper then lines it with Rip Rock and makes it flow neatly through his property..
Turns out these channels are designated as "Federal Wetlands" and he had to return it to the muddy mess it was :(
When we replaced the bad culvert that channels one under our road I called just to make sure we could install a larger culvert LOL wasn't taking any chances..
Many of these old laws go way back the the "Range War" days when people would dam off steams and dry out their neighbors
