My brother in law just said the same thing, only replace the word texting to something I can't wrrite about here, and well, can't be done alone in the car.

Don't know about Texas, but talking on a cell phone and texting while driving are illegal in Georgia. I would imagine that he will have a hard time collecting a settlement from his insurance company for having an accident while committing of a crime. :(
