Default Federal laws trump state laws

That's what Oklahoma and Nebraska say. They have filed a lawsuit against Colorado saying the pot law is hurting them because their citizens are going to Colorado and bringing back weed. They say Federal law makes marijuana possession illegal and Federal law trumps state law.

Hmm...funny don't those two states refuse to enforce Obamacare? Isn't that a Federal law? I guess you get to choose which federal laws trump State ones and the other way around.

Don't get me started on the pot laws. Most people don't want to hear another rant.

Both Oklahoma and Nebraska have Federal Run Exchanges. Federal ran exchanges may not be legal based on the original language in the Affordable Care Act. The Supreme Court Will Decide the Case in 2015. Depending on the Supreme Court ruling the states of OK and NE may have a valid argument.

Can't they put their state troopers at the state borders and check anybody who crosses the state line for pot?

That would be profiling. Remember we are a nation that's politically correct.

Mute point. Congress just passed a law saying DEA can not prosecute medical pot. This argument will be over soon enough .

Trafficking over State lines is an offense though. But who is going to catch them. Think Mexican border :<0)

The DEA enforces Federal laws not existing state laws.
