As long as you can show that the elements of the crime have been met, and there is reasonable suspicion that the crime was committed by said person, you can make an arrest, usually. Upon conviction in a court of law, there is sentencing which imposes punishment for the crime as prescribed by law. People are arrested for and investigated for suspected criminal wrongdoing where the elements of the crime are met all of the time without being convicted.
