An act that is unlawful is by definition, a criminal act. My understanding is that housing top secret documents on a private server is an unlawful act.

I can certainly rephrase by saying: If elected, Hillary would be the first president where the public was aware of criminal activity and elected her anyway. If that makes you feel better.

Bill Clinton was acquitted in regard to HIS criminal activity in the Oval office. Does that mean the criminal activity never took place? Of course not.
