Ok, but what if Obama had made a bunch of treaties, agreements, etc., and then it was found he didn't have constitutional standing to do so until much later? What would you do then? I understand the Constitution might cover the landscape, but what of the details? Also, I'm not aware of anything in the Constitution addressing this specific eventuality. Please enlighten me.

Thanked: 55The 25th Amendment deals with the death and disability of the president. Ineligability would be a disability under that amendment. Once the disability is discovered Biden would automatically become president. Anything Obama did up until that point would stand as it would have been done in good faith. To be sure though I am positive that the Congress and the new president would probably quickly redo the bills just to imbue them with legitimacy.

Well, I suppose he'd be sent home with all his stuff and the possible legal proceedings for forgery (or whatever it would be termed) would ensue. He'd be jobless at the time since he wouldn't have his senate seat. As for whatever he did while in office, well, I guess we just get caught with our pants down. I'm sure though that Biden would follow suit with every last president and both pardon and honor Obama
