I turn to you all in a time of dyer need. I recently sent a mint condition sealed copy of the special edition tin for mass effect 1 on xbox, I packaged it like mad with all the bubble wrap i could find, I sent it with royal mail special delivery the most expensive method so I'm covered for its price of £275, however its gotten to the seller and I'm told their is a tear in it and he wants his money back. its through ebay an I am really frightened that they will take the money from me forcefully and ill get a game back that I sent as valuable and received as worthless, basically if its sent back to me i can sell it for like £40 tops, this money was going towards a mac book air for library study. Where do i stand. what rights do I have as the woman on the phonee at ebay for lack of a better phrase said "you aint got a leg to stand on as a seller". I turn to people who have had things like this happen to them in the past and how they where resolved, thank you in advance for any advice offered

There's a tear in what exactly? do you have pics of the condition before you sent it, i.e. posted on the bay?
If you sent it special delivery it's insured so if you still have the receipt you should be able to claim from royal mail.

Thanked: 1I have a 720 video of it all around, hi def images and the receipt where I declared it was £275, however the packaging when he received it was fine, no problems, therefore royal mail won't do anything once they see that. Based on the research Ive done I have no one to turn to, not royal mail, not ebay or paypal, the only person who could help me here would be a financial ombudsmen.

Right, I'm not actually clear on what's wrong with the item, but if you have images of the item intact, packed it correctly, etc then you have grounds to say that the buyer damaged it on his end and is trying to shaft you?

Thanked: 1Thats what I was thinking, but Im kind of a softie lol, I don't really want to point my finger at him saying it had to be you, as it may not have been him resulting in him feeling like I'm the bad guy. If thats what it comes to then thats what it comes to, but the problem is ebay, basically they will fight his corner, as a buyer you are covered, as a seller you have little to no right or cover from ebay, its dispcable in my opinion that one side of the community is 100% protected and the other have no help. Thanks for the replies, means a lot to be heard in an hour of need

when you say a tear, do you mean in the cellophane wrap?

Thanked: 1I do, the game was sealed in its original plastic wrapping, around it I placed a layer of bubble wrap, then within the box I padded a large cardboard box with loads of bubble wrap so it was protected from all sides and angles, its impossible that it tore when I was packing it, and its impossible in transit that it could tear on anything inside the box

I have loads more pictures of it before I sent it that I actually sent to the guy before he agreed to pay, also the video made about 30 minutes before I posted it

Pictures, pictures pictures.
What pictures to you have to document the condition
as it left you. Serial numbers...?
Did the buyer also document how the package arrived.
There is always a chance that yours was swapped
for one that was in less condition. If your pictures
that show a minor mark in a specific location and
the returned is not the same you have postal fraud.
Since the price is in £ I suspect my knowledge of
key words that excite the US Postal Service is no help...
Speaking of bubble wrap and packing....
A while back someone remarked that razors
should be shipped in a roll of bubble wrap
that was secured with rubber bands. His point
was that the rubber bands did not require a knife
to gain access to the inside and it was safer
for the razor and all involved.

Always suprises me what people will spend £300 on, don't get me wrong, i love mass effect.
i noticed you stated that there were no tears on the auction page, and he's claiming there is. He could be a collector wanting a sealed copy that he never intends to use, or as nifty said above, he switched on you. Regardless, you have the pics proving it left you in sealed mint condition
