Thumbs down Beware of ebay seller tomfla !!

I purchased two razors from this seller a month ago. Here are the item numbers in case you are interested................ 200029635910 & 200029633818 (this is the problem one)

The "JA Heckles Razor New In Box Germany NO RESERVE" is the one I had a problem with. I received it and it was not NIB as indicated in the title or description. The seller is extremely rude and has made no effort to correct the problem. And of course ebay has been zero help at all! That is the short version, the long one is below

I realize the pic of the Henckels was not the best but then again most of the pics taken are not any good. It was a pain to deal with due to him not taking paypal and him waiting a day and half to get me an invoice so I could pay him. But I got the postal money order and sent it priority mail with delivery confirmation the very next day after he got me an invoice. The invoice was incorrect as he double charged me for delivery. As you can see he has a shipping discount for multiple sales. He agreed on the corrected amount, it was sent, and received rather quickly.

I then received the razors. Packing was poor but they did not get damaged as far as I know. I checked them over and they were both dirty but I didn't think much of it. The Heckels had hair inside and out, had soap scum in the usual spots you would expect for a used razor. The pin on the Heckels was rather loose, but other than that it seemed like a nice razor worth $20 to me.

I had looked at lots of auctions since I had won these from this seller and I had forgot that the Henckels was supposed to be NIB. So I left feedback the same day I received the item as I always do, even though he had not left feedback for me. A few hours later I reviewed the auction and realized the item was not as listed but learned it was hard to take feedback back and it was not worth the trouble. As stated about, I thought it was worth what I payed, but I was not happy due to his false advertisement.

I let a good week go by and still had not received the feedback I had coming. I payed promptly and had proof of that. So after that week I send a reminder to him figuring that he has a lot of auctions and lost track or something? Three or four days go by and still no feedback, so I send another message stating only "Second request for feedback". This is what I received back:

    2nd time ignoring it.
I was not happy at all. How hard is it to leave feedback?? So this is what I sent him.

What is your problem. I gave you positive feedback even though the razor you sold me was NOT as advertised! It was NOT new, that's why I had to clean all the hair off of it. I paid promptly, I fulfilled my obligation and should have received my feedback right after you got paid. I included more than enough info for you with my payment to make it easy for you. I still have no feedback. Do you enjoy being difficult??
And this is what he sent back to me:

People will give feedback if they want when they want or not if they dont want to. You do not need to request it. Repeated nagging is not a good thing and I dont think will help you.
Since he is a rude a** and refused to so something so easy and since he is also a liar with his listings I decided it was worth the trouble to file an "item not as described" complaint:

Item Significantly Not As Described: JA Henckels Razor New In Box Germany NO RESERVE (#200029633818)
Payment Method: US Postal Service Money Order
    Payment Date: Oct-02-2006
Additional Details: Razor was listed as New In Box.The razor was full of hair inside and out, had gunk/soap scum built
up. Also the blade is very loose in handle.Blade has scratches on it.This clearly indicates the razor
is not "new in box" as stated in the auction.I left feedback before reviewing the listing. Decided
it was not worth it to file complaint, now seller refuses to leave me feedback, I have asked twice. He
stated he was "ignoring me".I now want a partial refund or a full refund and I will return razor.
Mr Tomfla never even responded to this. I imagine because he sells a lot on ebay and realized that there was nothing I could do. See, since the amount is under $25.00 I am SOL. I did not know this. Here is ebays response when I tried to escalate this to a claim:

****Transaction: JA Henckels Razor New In Box Germany NO RESERVE (#200029633818) sold by tomfla on Sep-27-2006.

Dispute status: Open - Other party has not responded.

We're sorry you weren't able to resolve the problem with tomfla. Unfortunately, your claim does not qualify for reimbursement under eBay's Standard Purchase Protection Program because the sale price of the item is below $25.00.

However, by closing the dispute, eBay's Trust and Safety team will be informed about this transaction and your unresolved concern will be noted on the seller's account. If warranted, the seller's account may be restricted or suspended. Due to privacy concerns, we will be unable to share the details of any action we take. If you have any questions regarding the status of the seller's account, please check their feedback profile page. ****

So the bottom line is you are on your own. Its not the $$, its the fact that this guy can lie, be an a$$ and ebay will not help you. I will never purchase anything on ebay again unless the buyer uses paypal, I would suggest the same to the rest of you. I will also not be purchasing any more razors on ebay unless I am willing to take the amount of cash it costs me and trow it in the trash can, because that may be what I am doing anyway. I would rather pay more and buy from someone here.

In the end he has to live with the type of person he is, so that makes him the looser. I am only out a few $$. Just wanted to let others know before they bid since he does list a lot of razors. Had I paid $50 or more it would be a little harder to swallow. I am done ranting now

I feel for you brother. I've had a couple run in's with sellers who DON'T accept Paypal. ALL of them have been a pain in the ASS. One of them even claimed TO accept it, only to tell me after the auction that he was "having paypal problems". Three weeks later it still wasn't resolved. I told him I wanted out and walked away.
My policy now is PAYPAL ONLY.

Sorry for your pain, but hopefully you can make something good of that Henckels.

Its not a bad razor, it has hone wear but not much. The edge is decent and the pin can be snugged up and I am sure it will be a nice shaver. But, I would not have bid that high if I knew it wasn't going to be NIB as listed.

Request his personal info. You should be able to request anyones personal info that you buy or sell to/from.

Ebay will send you an email with his full name and phone number and he will receive an email with your info. Or you could just check out his shipping address and get his phone number from an online source.

Then call him and bug him. Call in the middle of the night and tell him that his breath smells, or something else really really mean.

Lastly, I think you can respond to feedback. Feedback that is left for you and feedback that you have left. Perhaps you can add some info to your original feedback.

I bought a set of mini drills for about $3. The seller wanted $13 total and when the package arrived, it had about $2 in postage. When I contacted him, all he said was, "it's still a good deal." I think it was a better deal at $5, which is why I bought it, but what do I know!

Just make a note of it, and don't give this peckerhead any more of your business. As it is, I leave feedback after I get my item and inspect it. I don't really care what they do. I did what I was supposed to, and they can go hang. It won't take too many customers before this guy figures out he's a dick. If not...hey, at least he's not taking any more of your money.

    Angry

I had the same problem with flea boy a while back,It was my first bluey, from a lying bull shit artist and when I complained to flea boy I go t the same response,There is one thing I can`t stand is lier's,especially when it involves my good name, anyway just thought I would share that with you because your not the only one. I feel very strongly about it and 6 months down the track I`m still bloody pissed off, with the seller but more so with flea boy because of their lack of action and their ever increasing list of excuses. If there was another entity where we could buy and sell flea boy would be a distant memory by now and they came very close to being one
    anyway your not alone
    Kind regards Peter

I had several successful transactions with money orders, but now I won't even bid if the seller won't take paypal - it's just not worth the risk.

I know of all kinds of ways to be mean and nasty in a situation such as this. I am a member of an automotove forum as well. Somebody got screwed over on there. They have over 10,000 members and the guy that got screwed over was a well liked guy. One of the members even lived close to this scumbag and went to his house and left a nasty note on his door since he wasn't home. He then got signed up for every piece of spam, junk mail (gay porn, condo sales, etc.) and anything else you can think of. People also called him at all hours from all over the country and bugged him. He got screwed for a couple hundred dollars on a watch from ebay. I think it was a case of the guy selling a bunch of junk and getting his feedback up there. Then he listed the same thing a bunch of times and never sent the item to anyone. I don't know how that ever turned out.

I got screwed by a member there as well. He had been around for a while and I could find no issues he had had with anyone else. So I sent him $220.00 money order for a high performance intake system, saved me about $100 as it was slightly used. It never showed up. I went round and round for a while and eventually he quit responding to me. He's in West Hollywood CA and I am in WI, im SOL.

I learned my lesson. Bottom line is my job is not worth getting in trouble over something as stupid as this. Not to mention he has my address and could be annoying to me as well. I deal with rejects like this on a daily basis and you can not win an argument with them. The only thing they understand is punishment and consequence, and ebay is not going to provide that. They have no dignity, honor, or personal code and only look out for themselves and I cannot fix that. You just have to hope that it is true, "what goes around comes around"

Yea I've had my share of run-in with idiots on Eboy but I wouldn't be so quick to dismiss all of Eboy because most people who sell are really honest and decent people who try and do the right thing.

My feeling about the guys who don't take paypal is that unless its something I'm really wanting real bad I pass it buy. Its just a hassel to me to have to go to the post office and wait in line 30 minutes to get a money order and snail mail it out. Most of these guys don't accept it because they're not going to pay those big fees to pay pal meanwhile they get about half the number of bids they would get if they accepted paypal so who's the loser there?
