Yes, the logging regulations in my province do not allow logging companies to clear cut to the waters edge for that reason also.

The Fifth Amendment to the U.S. Constitution declares that no person shall be “deprived of life, liberty, or property, without due process of law.”

Is it possible that the Federal government agreed to settle because they realize that their appointed thugs, the EPA, had acted in violation of the 5th Amendment, and imposed penalties on this man without "due process"? Could be. Maybe this wasn't so much a case of common sense, maybe more CYA.

This reminds me of something. How much did the EPA fine itself when it spilled mine waste water in the Animas river of Colorado last year?

Unfortunately, the appointed bureaucrats of the EPA are not only immune from public opinion since they are not elected officials and can't be driven from office by legal means required by the US Constitution, they also enjoy sovereign immunity which means they do not have to fine themselves.

Everything is so much more convenient when you're above the law.
