It's difficult because you said the waiter returned with a fresh cup.
I'm going to go ahead and say he either poured it into a new glass, or the tea was the same flavor (different glass of tea, but still the same tea).

James is correct. The waiter tipped the same Tea into a new cup after removing the fly. And since you answered the next riddle as well James I think you can take up the lead....
