    Well, it would be slander, not libel here, right? It is spoken word, not written.
    And what did he say that would actually defame her character? If the joke was truly about "the rape of a 14 year old" how does that defma HER character? A-Rod would have the case, not her.

    Sorry. I'll take off the lawyer hat now...especially as I have necxt to no knowledge of defamation law aside from that I heard in law school.

    Was it tasteless? Yeah. That's really as far as I would go. I don't see anything actionable, though, legally or criminally.
    Would these particular nut-jobs be protesting for his firing if the joke was about an Obama daughter? Hell no. A whole different set of nut-jobs would be protesting (with some overlap, I'm guessing from certain groups).

    I agree that her response is politically motivated. Though I am conservative, I am certainly not a republican. If Jindal gets the nomination with Palin, there will be more Republicans voting for Obama than Democrats. As for the joke, its TV and the road to hell is filled with people like Letterman. He cares only about himself and because he has no personal moral code or conduct, he makes comments about Christians and conservative that are tasteless. Now, I am no fan of Palin and I think she was only chosen because she is attractive for her age and is as brainless as GW Bush. But, if the child were mine and he embarrassed her on national television, the plastic surgery he would need and the fact he would have no vocal cords would make him undesirable to CBS. That is what he deserves. Any reasonable, moral adult would not pick on another adults children. Children do not choose their parents.

    I wonder if there'd be this kind of backlash if say Robin Williams made the joke (about the 18 year old) on an HBO special...

    Now if Letterman had picked on Palin fine no problem, but to stoop to picking on her daughter????? FOUL !!!!! and yes he should be fired...

    If a right winger picked on Obama's kids they should be fired too.....


    Children should be off limits Period !!!! Including from Paparazzi I think pics of stars kids should be illegal to publish too....

    BTW I don't have kids, but to me it is just morally wrong...
