Although I do agree there is need for us to do something, our Constitution is still the governing document for all we do. I do agree with the judge's reasoning. There is nowhere in either the Commerce section that defines inactivity, or not participating in commercial activity, as being activity; or the taxation section defining this as a tax. In fact, the word tax is not used in the law. It is a "penalty" which is trying to be defined in the law to be a tax. Non-participation is not a tax, but a penalty for not participating.

Another determination that Obamacare is unconstitutional, and struck down the entire law, as the individual mandate is not severable from the entire law.
I can't wait to hear what the Supremes have to say about this.

These terms crack me up. How come you don't call it Romneycare? He signed the same long-standing Republican idea of insurance mandates into Massachusetts health care reform.

Repubs: "You're not willing to compromise!"
Dems" "that's right, we are going to ram it down your throat, whether you like it or not, and use 'reconciliation' to further end run around the will of the people, because we know better than them."
The people: "that's unconstitutional!"
The Judge: "Yep, unconstitutional"
