O.K.
I am getting married in 12 days. But, my fiances current health insurance expires next week.
Under HIPAA, this one week lapse should not count towards any kind of "pre-existing" clause in the future right?
I'm wondering if we should get married by the justice ahead of the wedding just to make sure everything is covered.

The insured has to have maintained a Creditable health insurance plan for a year -without any lapses greater than 63 days - for his or her insurance coverage to be immediately transferred to the new healthcare plan without a pre-existing condition exclusion.

Thanked: 199I would call the insurance company that she will be under once you two get married and ask them.
But according to the info you quoted, as long as she had her insurance for a year, without a lapse of more than 63 days, it sounds like it should be ok.
I would call to check anyway. And if possible, get them to send it to you in an email, or letter, so that you have it in writing...again, can't be too careful...insurance companies can be jerks sometimes

"Unfortunately, there is one huge exception to HIPAA: It provides no protection if you switch from one individual health plan to another individual plan." springs from the text. Is her insurance policy a group insurance or an individual one?
Also, congrats on getting married.

I would call your insurance company immediately since it can be difficult to get a judge to marry you within a few days or even weeks.

Why, what are you planning for the wedding night?
Send me your address and I'll mail you a gimp leather suit as a wedding present, I think there's still enough time to arrive on time. It comes with nice red ball too, but I need the whip, so you'll have to find your own.

Every state can be different in the answer to this question I believe. If worse comes to worse, a lot of times you can purchase a temporary plan for the amount of time that your coverage will lapse.

Thanked: 1262it is going to be a lapse of about one week while transferring from her individual plan at her old company(severance is ending) to a family plan at my company.
Actually..i should have her double check when the insurance coverage actually ends... Because insurance is paid for a month in advanced i think...
