Unless he made a statement about the condition of the scales that run contrary to the actual item, it is not the sellers fault if no requests for further photos or details were made.
In such a case, it up to the sellers good will decide to refund or not.

I have talked to him and he said that he would refund my money. So I will probably go that route . I have just been wanting one of these razors for so long.

Keep it and sure as shootin' a really nice one will come along for $350 - $400. Then you'll have that and you won't get your money out of it. There was a guy on SRP who had one on ebay a couple of years ago. He was looking for like $400 and it was a really nice one. Had the original lifetime pouch and everything. Do a search in the ebay forum for reaper and you may find who it was if you have the patience to weed through the threads. I know we talked about it and at the time everyone said he was asking too much. I don't remember who it was or if it ever sold.
