    Under such circumstances I beleive you're allowed to punch them once in the throat before it's considered assault...

    I can't remember the movie title, but someone stabbed someone else in the throat with his fingertips. The person fell down, and he was helped up again by the person who did this.

    My wife asked me 'could you do that'?

    I explained that , yes, I could, but in real life, one of two things happen:
    1) I wouldn't stab hard enough, and the other person would think I am a wuss, and then optionally kick my ass.
    2) I would stab too hard, and be tried for assault, grievous bodily harm or murder in the 2nd degree.

    "re-negotiate his commission" ?

    I'd fire the guy and find a different agency all together to represent me.

    Unless said re-negotiating might reach negative digits?

    We've signed the contract and there's basically no way out of it unless the buyers pull out for some reason. So we are stuck with him. Our solicitor is trying to sort out the mess, but the bottom line is that because we signed the contract with the dodgy clause in it, we are legally bound to continue with the sale under the contract conditions, and that includes paying the agent his commission for enabling the sale.

    Like I said - never, ever sign anything without proper legal advice first. For a supposedly smart guy I can be a real dumbass

    James there is a way out ,complain to the board in your state and tell them you want out because of his unethical,and (here) criminal conduct(manipulating the sale for the buyers benefit)Insist that they pull his license.You dont have to put up with his shit ,and Id tell him so,and that I was going to bring him up on charges.Best Regards gary

    Well James if it makes you feel any better, I've never thought of you as particularly bright ---- you can fool everyone else with all that high math lingo -- but I know - I know -- take it easy mate, it's all a learning process I suppose, we're all just improvising .

    Thus the saying no one likes lawyers until you need one......surely there must be a consumer protection agency with your state. And I would definitely file a complaint wherever possible and especially with the Realtor board.

    Was he hired by you to sell your house or was he hired buy the buyer first? That determines who he worked for first.

    I used a realtor when buying my current house - even though it was being built for me. She saved me a couple thousand bucks...which is a small consolation given the crap construction. Passing code in the US = it won't fall on your head if you sneeze and your hairdryer will not cause an electrical fire.....



    Anyone watch "Holmes on Homes" on the Discovery Home channel here in the US? He is a Canuck from Toronto who goes around helping people that have been screwed by contractors. Very informative.
