Its that borderline that is extremely important.
I'm going to make a statement.
Blacks are more likely to end up in jail.
Is that racially motivated hate speech, or just a fact?
Now in order to determine weather or not I'm a criminal is up to how you perceive my motivation in making a statement. That is something you cannot do. Yet I can gaurantee that there is a reader out there offended by the above. Even though I didn't imply a cause of any type and you can check the fact of the statement someone is offended and believes I hate them because of their race. Did I commit any type of crime? Should I be prosecuted? You can bet that at least one person is saying yes. If that person is in the wrong place they will ruin the lives of a lot of people who are in no way guilty of any real crime.Last edited by Wildtim; 06-23-2009 at 04:34 AM.

here's the thing, speech is protected, calls to action are not. for instance (this is just an example, I don't actually hate Zoroastrians)
"I hate Zoroastrians. I think they're hella lame, and you should all hate them, too. Let's form a club so we can hate them more effectively, and send out flyers and have parades about how lame they are. Let's brainwash kids with propaganda about how lame they are so they'll grow up to hate them, also."
This is legal.
"I hate Zoroastrians, let's go lynch some."
This is not legal.
