That's the thing though, afik the federal laws trump state laws, so if a state decides that they are no longer going to pay their former employee the pension that they had mutually agreed upon say some 20 years ago, I don't think that just changing the state law to say it's cool would fly. But I really don't know all that much.

Gingrich and Jeb Bush are actually pushing the Republican members of the House and Senate to make it easier for states to file bankruptcy so that they can get out of their pension obligation to retirees.
