Thanked: 271Well, since everyone agrees that this "war" will last for a long time, I guess you can just kiss your constitutional rights goodbye. Isn't it impressive how easy it was to lose your liberty?
The suspension of constitutional rights using the excuse of war and basic ignorance of what those rights were are the main reasons why the United States has already slipped into Fascism and why almost nobody seems to notice.

If it is a matter of national security a closed trial would be perfectly acceptable. It happens all the time with cases hinging on secret material.
There seems to be an assumption that these guys were all rounded up while they were dancing a jig on the runway of the airport they just bombed. If that's the case then it should be easy to please everyone, save the jiggers. Few would argue that they have forfeited their rights if they have engaged in terrorist or espionage activities. The assumption though, is that because we are holding them with complete disregard for any rights, they must be terrorists.
As to the original post, I wouldn't suggest that the US take it's cue from the Taliban as to jurisprudence, human rights, or conflict resolution of any kind. I sincerely hope that everyone in the US holds every single one of our institutions to a much higher standard.

my constitutional rights are not in question! The question is whether non citizens and enemy combatants should be afforded these rights!
Becareful throwing the "F" word around. I would think that you being from Italy, you were taught in school about your recent history and would understand what this "F" word means, and would likewise understand that America is not the definition of this word!

Thanked: 271No, you are not correct. Jose Padilla is a US citizen who was designated an enemy combattant and stripped of his constitutional rights. If it happened to him, it can happen to you.
Another factual error. I live in Italy but I'm from Chicago. As for Fascism, we hold sham elections where we elect representatives who vote for whatever their corporate donors want, we launch imperialistic wars, justified by lies, against the express will of the people. The news media are all owned by large corporations that censor the news ... don't get me started.
