Does chronological proximity to the original constitution lend additional weight to the early amendments?

Yes the first 10 amendments are "The Bill of Rights" everything else came after and were done to adjust for the times... as you said a Living Document, changing any amendment is by design very hard, changing one of the first ten is near impossible by design...

The Court has the ability to decide as to the interpetation by Laws what some of those amendments actually mean, but to erase one or to change it at it's very core would require a huge effort...

Take Freedom of Speech, the court decides what that really means and what is protected by the Amendment...

I've been thinking about this knee-jerk reaction of the public being scared. I like part of it, that means that there is plenty of "like-minded" pro-gun people out there & that those who have been throwing around the plastic this week carelessly will be selling me "toys" at a discounted rate once the credit card bill comes in! Win-win!

There seems to be a push back response involved here too..

Talked with my Sis last night for over an hour, as she has decided that nobody was going to take a right away from her, she has never even held a weapon never really had a desire too... They are shopping Handguns and and Shooting instructors, my Bro in Law started the CCW process for himself, all this not from anything other then a direct response to the Media push against the RKBA..

My wife imformed me that after the holidays she wants her CCW. for no other reason then she wants to be able to carry if she desires too.. The run on the gun stores and and retailers, is proof that others are thinking the same, not only of people planning on making the money on re-sale..

Default Potential Ban/Brady Bill part deux?

Was at the docs office this morning and his nurse told me she wants her CHL so I gave her one of my buddy's cards.
Was really interesting hearing her points of view.

I've said it before, and someone probably already said it here, since gaining office, President Obama has unwittingly done more for gun sales than Samuel Colt. I normally stay away from these boards, they seem futile, like religion, people have made up their minds and tend to argue rather than discuss. As for myself, as long as the police response time for me is six minutes, at the very best, and my Glock is ten seconds away; I will opt to keep my gun. I've been wanting to get my CCW for some time now, as soon as my cast is off my leg, off to the Sheriff I go!

Yeah I am getting a bit of e-mail from my Non -Shooting friends lately asking questions, it is rather interesting to hear, their reasons for all of a sudden deciding that now is the time..
Many of these people have been friends since the Clinton era and that never prompted them to become gun owners, a small few are Obama supporters too, which of course I busted on them for but it seemed funny that now they are seeing that a right is still a right, and they want it...

Considering that the relevant bit (2nd amendment) was itself by definition the result of an amendment to the original constitution, one thing I've never understood is the absolute and complete opposition to any mention of even considering amending (even by way of clarification) that particular amendment. Have other constitutional amendments themselves been amended? I don't know if that is even possible (again, I plead ignorance on these issues), but if other amendments have themselves been amended or superseded, what exactly is it that makes the second amendment so sacred? Is it simply the association made between the right to bear arms and freedom as illustrated by Mr. Jefferson?

    Thanks Professor Wullie!
The answer to your question is yes, it is all about the public being able to defend their liberty. What you have to remember is that these people at one time were loyal BRITISH serving the crown, until they could no longer tolerate the demands of the crown. Our Founding Fathers wrote this into the Constitution in the event we should need it again.

BTW The 2nd Amendment is not an amendment at all, as amendments are amendable, what we carelessly call the first 10 Amendments( The Bill of Rights) are actually the first Articles of the Constitution and are not amendable.....in theory.

So, my question is...what if the second amendment didn't exist? Do you really think things would be any different? I say no. It's a tool to be well used by anyone afraid someone might take their guns away. There is just a mania and paranoia about guns in this country and if the second amendment didn't exist there would have been passed some law giving pretty much the same rights. The politics would be the same and it would be near impossible to change such law.

So my point is instead of always parading out the second amendment like beating a dead horse why not be honest and just say "I love guns and everything about guns". Now everyone go to your window and open it and yell it as loud as you can. Others will join you and you will feel much better.

I'm not a fan of The Washington (com)Post, nor am I particularly fond of anything Krauthammer has to say. I just read his op-ed column and in this particular instance, I think he's pretty much on the mark.
